You have the right to access your data at any time, to rectify it, or to request its deletion by contacting our customer service.
General terms and conditions of sale
The present general terms and conditions of sale define the contractual relationships between Atlas Design Sàrl hereinafter referred to as "the seller" and any natural or legal person wishing to make a purchase on our site www.atlasdesign.ch .
As a result, the act of any person ordering a product offered for sale on the website of www.atlasdesign.ch constitutes full and unconditional acceptance of these General Terms and Conditions of Sale, of which the Client acknowledges having been informed prior to placing their order.
The company Atlas Design Sàrl reserves the right to modify the general terms and conditions of sale at any time.
Article 1: Completeness
The present general conditions express the entirety of the obligations of the parties. In this sense, the Client is deemed to accept without reservation all the provisions set out in these general terms and conditions of sale.
Article 2: Purpose
The present general conditions aim to define the rights and obligations of the parties within the framework of the online sale of goods and services offered by Atlas Design Sàrl to the Client, from the order to delivery, including payment and the use of services provided by Atlas Design Sàrl.
Article 3: Scope of Application
The present general conditions govern the sale of products on the day the order is placed by the Customer. They apply to all methods of placing orders remotely offered, whether the order has been placed via the internet or by telephone.
Article 4: Order
Capacity to contract
Every Client declares themselves to be of legal age and to have full legal capacity, allowing them to commit to these general terms and conditions of sale. The company Atlas Design Sàrl reserves the right to cancel and refuse any order from a Client for a valid reason, particularly if there is or arises during the processing of an order, a dispute, especially a dispute related to the payment of a previous order.
Acceptance of the Terms by the Client
The act of the Client ticking the box "I have read and accept the General Terms and Conditions of Sale" before proceeding to payment constitutes an irrevocable acceptance that can only be challenged in the cases explicitly provided for in these conditions under the paragraph "right of withdrawal". The Client acknowledges by this act that they have read, understood, and accepted these conditions.
The purchase by telephone also implies acceptance of these Terms, which he acknowledges having read, understood, and accepted in the aforementioned conditions.
Order placement
The Client can place their order online 24/7.
The ordering process consists of seven steps:
Initially, the Client must select the product(s) they wish to purchase.
The Customer must then validate their shopping basket.
The Client must verify the selected products and indicate the requested quantities.
The Client clearly identifies themselves. The order can only be registered on the site if either by entering their personal email address and password, or by providing all the information requested for online registration.
Once identified, the Client must clearly indicate the information necessary for delivery, particularly the precise delivery address as well as any potential accessibility restrictions (building, floor, entry code, etc.).
Second to last step, the Client must indicate the chosen delivery method.
Finally, the Client must indicate the chosen payment method in order to proceed with the payment of their order on the secure interface, which will formally and definitively establish the sales contract that binds them to Atlas Design Sàrl.
Any order constitutes acceptance of the prices, shipping costs, and description of the products available for sale. Any dispute on this point will be addressed within the framework of a potential exchange and the guarantees mentioned below. The online entry, on the form of one of our payment partners, of the credit card number and the final validation of the order by the Customer will serve as proof of the firm order and the enforceability of the amounts for the ordered products.
Order Confirmation
An email is automatically sent to the Client to confirm their order, provided that the email address provided in the registration form is free of errors. Any error in the indication of the email address by the Client will be the responsibility of the Client.
Order tracking
The Client can track the status of their order by checking the "My Account" section on the website www.atlasdesign.ch
For any questions regarding the tracking of their order, the Customer can contact the Customer Service of Atlas Design Sàrl by email at the address info@atlasdesign.ch from Monday to Friday, excluding public holidays, from 09:00 to 17:00, in order to open a dispute or investigation file to conduct a search for the parcel.
Proof of transaction
The electronic records, securely stored in the computer systems of Atlas Design Sàrl, will be considered as evidence of the communications, orders, and payments that have taken place between the parties. At no time does Atlas Design Sàrl receive, store, record, or transmit its clients' banking information. All banking information is processed directly by its specialised partner (Stripe).
The archiving of purchase orders and invoices is carried out on a secure medium that can be produced as evidence.
Article 5: Product Information
Product Features
The Client may, prior to placing their order, review the information on the site www.atlasdesign.ch , the essential characteristics of the product(s) he wishes to order. The Customer can select one or more products from the various categories offered on the site www.atlasdesign.ch .
The information, features, photographs and graphics presented on the site www.atlasdesign.ch or in the emails sent by Atlas Design Sàrl are not contractual.
The products being all handmade, they are likely to be different from one another.
A product placed in a setting does not imply the sale solely of the item described in the "product description". Atlas Design Sàrl shall not incur any liability for any indirect damages arising from this, including in particular loss of business, loss of profit, loss of opportunity, damages or costs that may arise from the purchase of the products. Atlas Design Sàrl shall not be responsible for any loss of data, files or damages defined in the previous paragraph.
Product availability
Atlas Design Sàrl only commits to fulfilling orders received within the limits of available stock of the products.
The stock status is only indicative. Availability may vary within the same day depending on the level of sales. Atlas Design Sàrl carries out very frequent updates of availability, but cannot be held responsible if the stock is no longer the same as that indicated.
In the event of unavailability of one or more products, Atlas Design Sàrl commits to only charging for the products that are available and delivered. The unavailable products will be automatically deducted from the total amount of the order/invoice, and the delivery charges will be recalculated based on the new amount (the recalculation of the delivery amount can only decrease, always maintaining the most favourable amount for the customer at the time of placing the customer's order). In this case, the customer will be informed by email of the undelivered and uncharged products at the time of sending their order. Items that have not been delivered will not be subject to a subsequent delivery.
However, if a ordered product is temporarily unavailable, Atlas Design Sàrl reserves the right to wait for its new availability in order to proceed with the complete delivery of the order (within a maximum period of 60 days). In this case, Atlas Design Sàrl will inform the Client of the expected delay or complete unavailability by email or by phone.
The Client may then request the exchange of the unavailable product or the refund of the amounts paid, no later than sixty days.
Atlas Design Sàrl may modify the range of products offered for sale on its website www.atlasdesign.ch
No cancellation compensation, apart from the full refund of the said Order, may be claimed unless the non-performance of the contract is attributable to Atlas Design Sàrl.
Article 6: Price
The selling prices of the indicated products are expressed in CHF and are inclusive of all taxes (VAT included). The selling prices of the products are those in effect on the date the order confirmation is sent by the Client.
The indicated selling prices of the products may be changed by Atlas Design Sàrl at any time.
The prices do not include delivery charges, which are the responsibility of the Customer and are billed in addition to the price of the purchased products based on the order amount. The delivery charges will be indicated before the final confirmation of the order by the Customer.
The prices do not take into account any promotional offers and personal discounts, which are indicated before the final confirmation of the order.
The prices include Value Added Tax (VAT).
Article 7: Payment
Payment methods
The full payment must be made at the time of order placement by the Client. At no time can the amounts paid be considered as deposits or down payments. The Client must pay for their order online by credit card using the following payment methods: Visa, Eurocard, Mastercard, Postfinance, ...
The Client guarantees to Atlas Design Sàrl that he has the necessary authorisations to use the payment method he has chosen for his order at the time of validating his order.
Atlas Design Sàrl reserves the right to suspend or cancel any execution of an order and/or any delivery, regardless of its nature and level of execution, for any valid reason, particularly in the event of non-payment or partial payment of any amount due by the Client, in the case of an ongoing payment dispute, in the event of a payment incident, or in the case of fraud or attempted fraud related to the use of the site www.atlasdesign.ch .
Atlas Design Sàrl reserves the right to request supporting documents from the Client before validating an order as part of an order verification procedure. The order will only be validated after receipt and verification of the submitted documents. If not received within 15 days following the placement of the order, it will be deemed automatically cancelled.
The Client can make purchases with complete peace of mind: Atlas Design Sàrl is committed to doing everything possible to ensure the security and confidentiality of data transmitted online, including bank details, through its payment partners. The site uses a secure payment mode SSL (Secure Socket Layer) which allows for the encryption of bank details during their transmission over the network. The Client can see that the transmission is encrypted by software as soon as the padlock symbol appears in their browser. The transaction is carried out via Stripe, which is the only entity that has access to the bank information provided on the site at the time of payment.
At no time does Atlas Design Sàrl have access to or can store the client's bank details.
Invoice
The Client has a copy of the invoice in the "My Account" section on the website www.atlasdesign.ch
Transfer of ownership
Atlas Design Sàrl retains full and complete ownership of the products sold until the full payment of the total price, including principal, fees, taxes, and mandatory contributions, has been received.
Article 8: Delivery
The delivery areas are: the whole of Switzerland.
The products are delivered to the address specified by the Customer on the order form and are understood to be delivered in the letterbox, or against signature, or if by carrier, at the curbside. The carrier places the goods on the roadside of the specified address. This means that the carrier will not assist the customer in bringing the goods into their residence, nor in unpacking or assembling them. The management of packaging remains the responsibility of the customer. No appointment can be guaranteed.
The Client is required to verify the completeness and accuracy of the information provided to Atlas Design Sàrl. Atlas Design Sàrl cannot be held responsible for any input errors and the consequences in terms of delays or delivery errors. In this context, all costs incurred for the reshipment of the order will be entirely borne by the Client.
Atlas Design Sàrl cannot be held responsible for delivery delays if these are attributable to a third party or to a case of force majeure.
Delivery methods and timescales
The preparation of goods and the dispatch of orders take place from Monday to Friday.
The delivery time is 30 working days from the confirmation of the order and its payment. However, Atlas Design Sàrl will make every effort to process the order as quickly as possible. Atlas Design Sàrl will inform the customer of the handover of the order to the carrier.
Orders will be delivered by DHL express couriers. At the time of delivery, an appointment will be arranged between the courier and the customer. The time slots provided by the courier can be up to 3 hours.
As soon as the parcel is taken in charge by the carrier, they will do everything possible to deliver it within 24 hours to 5 working days.
If the recipient is absent at the time of delivery, a delivery notice will be left at the address provided by the Client, allowing the Client to collect their parcel from a collection point designated by the carrier within a timeframe specified by the carrier (generally between 7 and 15 days). If the parcel is not collected within the timeframe set by the carrier, the products will be returned to Atlas Design Sàrl, who will contact the client to arrange for redelivery, with the shipping costs for the uncollected parcel as well as the new delivery being the responsibility of the Client.
Reminder: In the case of an order that includes one or more unavailable products as well as one or more available products, Atlas Design Sàrl will only dispatch the available products from the order and will proceed with the cancellation and therefore the non-billing of the unavailable products.
Conditioning
The products are packaged in a manner that complies with current transport standards, and to ensure optimal protection of the products during delivery. The Customer is requested to adhere to these same standards when returning a product. Any damage observed on a product upon return due to a failure to meet packaging standards may result in a refusal of goods and therefore a non-refund of the product in the event of an inability to resell it in its current condition or in the case of aggravation of the indicated technical issue.
For ecological responsibility purposes, Atlas Design Sàrl may be required to use packaging made from recycled clean packaging/boxes received for the delivery of its goods.
Customer's responsibility for checking parcels upon receipt
Atlas Design Sàrl reminds that it is the Client's responsibility to inspect their parcels upon receipt and to notify any anomalies (damage, parcel damage, missing product compared to the delivery note, broken product) to the carrier via the delivery slip. In the event that such notification is not communicated to the carrier immediately, the product is deemed accepted by the Client and cannot be the subject of any dispute regarding its delivery.
Delivery delays related to the carrier
In the event of a delivery delay compared to the timescales announced by the carriers, Atlas Design Sàrl initially suggests that the Client check with the carrier that the parcel is not on hold, and if necessary, to contact Customer Service by email at the address info@atlasdesign.ch from Monday to Friday, excluding public holidays, from 09:00 to 17:00, in order to open a dispute or investigation file to carry out a search for the parcel.
The Client must report the loss within 60 working days from the date indicated for the delivery of the order. Atlas Design Sàrl will then take care of making the necessary claims with the relevant carrier.
If the parcel is found, it will be immediately redirected to the Customer's home.
If, within a period of seven working days and not due to a case of force majeure, the parcel is not found, the Customer may request a refund of the amount paid.
Article 9: Right of Return
In the context of distance selling (without the simultaneous physical presence of the parties, such as an order made via the internet or by phone), Atlas Design Sàrl allows the customer to return their goods within 7 working days after the date of receipt. To do this, the customer must make a request to customer service info@atlasdesign.ch in order to receive a return slip and may send the item back to the following address: Atlas Design Sàrl, Route d'Entrebois 29-31 in Lausanne at their own cost and full responsibility during transport. The received goods will be refunded within 30 working days excluding delivery charges, provided they meet the criteria mentioned in the section "Condition of products" stated below and if the product corresponds to an item in stock and not a special order product.
Any return request, as well as any return parcels received after this deadline, will not be considered.
Exclusion of the right of return: Any discounted item is non-returnable. These items are neither refunded nor exchanged.
Terms
The Customer must include the delivery note of the order with their return package and indicate the reason for returning the product(s).
Atlas Design Sàrl recommends that the Client returns their products with a recommendation or additional insurance covering the market value of the products, ensuring compensation for the products up to their actual market value in the event of theft, loss, or damage to the goods. In all cases, the return is at the Client's risk. Furthermore, it will be the Client's responsibility to retain any proof of the return shipment.
Furthermore, Atlas Design Sàrl reminds the Client that no exchange or refund can take place before having first received and checked the compliance of the condition of the item(s) concerned by this request (see the conditions below).
State of the products
The returned products must be sent back in their original condition and in their entirety (product label, accessories, case, etc.). The products must be intact, in perfect resale condition, in a state of perfect cleanliness, and must not have been worn or used, nor show any signs of damage. Any used, damaged, or incomplete product will not be refunded or exchanged.
Refund of returns
The refund of the amounts paid is made to the bank card that was used for the initial payment of the order. Atlas Design Sàrl will process the refund to the Client within 30 working days from the receipt of the products.
Article 10: Guarantees
Unless explicitly stated otherwise, the seller guarantees the delivered products against any defect or manufacturing flaw that detracts from the product's promised qualities or intrinsic value.
Warranty Conditions
The implementation of the warranty consists of the exchange, at equal value, of delivered products recognised as defective or unsuitable, or the issuance of a voucher of the same value if the product is not available. The seller is in no way responsible for the direct or indirect consequences, both to persons and property, of improper use, poor storage, or inadequate maintenance of the products sold by him. The buyer is responsible for their custody and assumes the risks. The limitation period for warranty claims for defects is 2 years according to Art. 210 CO. In the case of replacement or repair under warranty, the warranty continues to run only for the remainder of the initial duration.
To submit a warranty claim for a product, the customer makes a request to customer service: info@atlasdesign.ch in order to receive a return slip for the warranty request. In the event that the service requires the return of the product, this will be at the customer's expense and risk. Once the item is repaired or exchanged, the product will be returned including the delivery costs at the customer's expense.
Article 11: Responsibility
The liability of Atlas Design Sàrl cannot be engaged for any inconveniences and damages related to the use of the internet, such as service interruptions, the presence of computer viruses or external intrusions, and more generally for any cases of force majeure or actions of third parties. Hyperlinks may direct to other sites than the site www.atlasdesign.ch .
Atlas Design Sàrl disclaims all responsibility in the event that the content of these sites contravenes the applicable legal and regulatory provisions.
Atlas Design Sàrl SA shall not be held liable for any indirect damages that may arise from the purchase of the products. Similarly, the liability of Atlas Design Sàrl under the obligations of these General Terms and Conditions of Sale shall not be engaged in the event of a force majeure occurrence.
Article 12: Force majeure
Neither party shall be deemed to have failed in its contractual obligations, to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. Any events or circumstances external to the parties, unpredictable, unavoidable, independent of the will of the parties and which cannot be prevented by them, despite all reasonably possible efforts, shall be considered as an act of God or force majeure. The party affected by such circumstances shall notify the other party within ten working days of the date on which it became aware of them. The two parties shall then come together, within a month, unless prevented by the force majeure event, to examine the impact of the event and agree on the conditions under which the performance of the contract shall continue.
Article 13: Personal Data
The personal data collected during any order from the Client is necessary for the management of the order by Atlas Design Sàrl and its service providers and may be used, subject to the rights exercised by the data subject, to inform them of the products or services provided by the said company and/or by its business partners. When the Client registers or places an order, or in the context of other specific operations, Atlas Design Sàrl offers the Client or Visitor the option to be informed about offers from www.atlasdesign.ch by email (newsletters, event emails, and promotional offer emails). If the Client or Visitor no longer wishes to receive these informational messages, they can modify their subscription at any time via their personal account in the "My Account" section on the site www.atlasdesign.ch , or inform Customer Service, or via the unsubscribe link contained at the bottom of each email sent.
Atlas Design Sàrl uses data collection systems such as cookies. A cookie is a computer file stored on the hard drive of the client's computer. Cookies allow for the identification of a previous visit by the Client or Visitor to the site and link the client to the personal data left on the site, particularly in relation to the identification of the shopping basket.
Article 14: Intellectual Property
All data of any nature whatsoever, including texts, graphics, logos, icons, images, illustrations, audio or video clips, trademarks, software… including the underlying technologies used, appearing on the site www.atlasdesign.ch , are necessarily protected by copyright, trademark law, and all other intellectual property rights. In this regard and in accordance with the provisions governing intellectual property law, only use for private purposes is permitted, subject to different or even more restrictive provisions of the intellectual property code.
The client agrees under these conditions not to reproduce, summarise, modify, alter or redistribute, without the express prior permission of Atlas Design Sàrl, any text, title, application, software, logo, brand, information or illustration, for any purpose other than strictly private use, which excludes any representation for professional purposes or for mass redistribution. Similarly, the client agrees not to copy all or part of the site onto another site or a company internal network.
Any other use constitutes infringement and is sanctioned under Intellectual Property law unless prior authorisation is obtained from Atlas Design Sàrl.
Any total or partial reproduction of the Atlas Design Sàrl catalogue is strictly prohibited.
Any creation of a hyperlink from a website to the site www.atlasdesign.ch must be subject to express authorisation from Atlas Design Sàrl. Upon simple request from Atlas Design Sàrl, this link must be removed.
Article 15: Completeness of the Terms
A change in legislation, regulation, or a court decision rendering one or more clauses of these General Terms and Conditions of Sale null and void shall not affect the validity of these General Terms and Conditions of Sale. Such a change or finding shall in no case allow the Client to disregard these General Terms and Conditions of Sale.
Article 16: Duration and application
The present Conditions apply for the entire duration of the online availability of the services offered by Atlas Design Sàrl. The latter reserves the right to adapt or modify these general terms and conditions of sale at any time. However, in the event of modifications, the General Terms and Conditions of Sale applicable to the order placed by a Client on the Site www.atlasdesign.ch are those accepted by the Client on the day of placing their order.
Article 17: Applicable Law and Jurisdiction
The sales of products on the site www.atlasdesign.ch are subject to Swiss law. Any dispute relating to the existence, interpretation, execution or termination of the contract concluded between Atlas Design Sàrl and the Client shall, in the absence of an amicable agreement, be subject to the jurisdiction of the Swiss courts. The legal venue is in Nyon.
